Me and my fiancée are planning to go to the US for a vacation to visit my parents and some relatives. My parents have been working there for quite long now. They are both working there for our daily expenses here in the Philippines to give me a better life. Since later this year I graduated with a BS Nursing course, passed the board exam and had a stable job for 3 years here in the Philippines, I think now is the right time to think ahead for a future living with my parents and with my Fiancee.
By the way, my fiancée is also a nurse which I met in work. We are now in a relationship for 3 years now and just got engaged last month. Before going to the US, we are planning to get married but US Fiancee and US Spouse Visa applications got me confused.
I thought at first they were the same but upon asking some cousins and searching the net, here’s what I’ve found:
US Spouse Visa
If you’re a married couple who wants to live in the US then you should apply for a US Spouse Visa. CR1 Visa or US Spouse Visa allows foreign spouse to enter the US and the Green Card is pre-approved. The processing time of getting a US Spouse Visa is from 9 to 13 months. To be eligible for this type of visa, the couple should be married to each other where the sponsor should be a US Citizen and has an income of $19,912 with an additional of $5,200 per dependent.
K-1 Fiancee Visa
This visa is for those engaged couples who are planning to wed once they are in the US. It allows foreign fiancée to enter the US. And if marries within 90 days of arrival, the Fiancee would be on Adjustment of Status phase where they will be eligible for application of Green Card. The processing time for K-1 Fiancee Visa has an average of 5 to 7 months which is 6 months faster that spouse visa. To be eligible for this visa, both members of the couple should be available to marry and the sponsor should have approximately $15,000 income plus $4,200 for the dependent/s.
Comparison
To live in the US, you should get a US Fiancee Visa or a US Spouse Visa, which both requires marriage. If you are already married outside the US, then get a US Spouse visa, else get a K1 Fiancee Visa where you have the intention to marry your Fiancee within 90 days upon arrival to the US.
If you want to have a faster processing of your visa, you should get a K1 Fiancee Visa where processing to takes only 5-7 months which is 6 months faster than the spouse Visa but of course much expensive which is $700 pricier because you will add the cost of the green card too.
